Terms and conditions
Last updated 12 September 2026
Hunt & Hammer is the private auction arm of Graeme Hunt Ltd, registered office 1A Coppock Close, Battersea, London SW11 2LE. In these terms "we", "us" and "Hunt & Hammer" mean Hunt & Hammer, a subsidiary of the Graeme Hunt Ltd company, and "you" means any seller, bidder or other person using our platform.
The platform is a private market for classic motor cars. Bidding is private: a bidder never sees another bidder's figure or identity, and no bid is published. There is no "buy it now", no land or objects of art, and no public bidding room.
1. These terms
1.1These terms apply to your use of the Hunt & Hammer platform and to every service we provide through it, including listings, private bidding, photography, transport introductions and storage introductions.
1.2By using the platform, entering a motor car or placing a bid you accept these terms. If you do not accept them you must stop using the platform.
1.3We may amend these terms by posting an updated version here. The updated version takes effect when posted and your continued use of the platform is acceptance of it.
1.4Where the entry form for a motor car, or the terms shown to you at the point of bidding, differ from this page, those terms take precedence for that transaction.
2. Definitions
2.1"Lot" means a motor car listed on the platform. "Seller" means the person who enters a Lot for sale. "Bidder" means a person accepted by us to place private bids. "Hammer price" means the accepted winning figure. "Reserve" means the confirmed minimum figure at which the Seller agrees to sell. "Private treaty sale" means a sale negotiated by us after an auction closes without a bid at or above the Reserve.
3. The platform
3.1We list, market and conduct the sale process. Unless a listing states otherwise we do not own the Lot, and the contract of sale is between Seller and Buyer.
3.2We may add, remove or suspend features, and carry out maintenance, without notice.
3.3Guide prices, estimates and any pricing guidance we give are indications only and are not a warranty of value or of the price achieved.
4. Your account
4.1You must be 18 or over. You must give accurate contact details and keep them up to date.
4.2Account verification confirms your email address. Bidding approval is separate: before you may place a bid we review an identity document you upload, in line with our anti-money-laundering obligations. We may approve, decline or reset that approval at our discretion.
4.3Keep your password confidential and do not let anyone else use your account. You are responsible for activity carried out under it.
4.4We may suspend or close your account if you breach these terms, misuse the platform, or attempt to complete a sale off the platform to avoid our fees. You may not close your account while you hold the leading bid on an open Lot or while any sum is owed to us.
4.5You must not manipulate bidding, impersonate anyone, scrape the platform, or post false, misleading or unlawful content.
5. Entering a motor car for sale
5.1A Lot must be entered through our entry form and accepted by us before it is listed. We may decline any entry.
5.2Seller's commission. 2.5% + VAT of the hammer price, payable on a completed sale.
5.3No sale, no fee. If the motor car does not sell, no commission is due.
5.4Withdrawal fee. 15% of the agreed Reserve is payable if the motor car is withdrawn after it has been listed.
5.5Exclusivity. Hunt & Hammer holds exclusive rights to sell the motor car for the duration of the auction and for 14 days thereafter. You must not offer it for sale elsewhere during that period.
5.6Reserve. The confirmed Reserve is binding. It may only be reduced in writing and cannot be raised once bidding has opened.
5.7Binding sale. The highest private bid at or above the Reserve constitutes a binding sale.
5.8Description and title. You warrant clear title, no outstanding finance, and that all information you provide is accurate and complete. If finance is active, funds will pass through escrow so that Hunt & Hammer controls the settlement, and an updated finance settled letter must be supplied before listing.
5.9Documentation and registration. The V5C must be supplied to Hunt & Hammer before listing. Where a private registration is to be retained, you are responsible for arranging and completing the retention.
5.10Auction end date. Requested end dates are indicative. We will use best endeavours but cannot commit to a fixed date, and we may extend or close a listing at our discretion.
5.11You are responsible for the accuracy of the listing, including where we help draft it. Photographs you supply must depict the exact motor car and you must hold the rights to them. You grant us a licence to use listing content and images to market the Lot and the platform.
5.12You may not bid on your own Lot. Until title and risk pass you must keep the motor car safely and in the condition described.
6. Private bidding and buying
6.1Bidding is private. Your figure and identity are never shown to other bidders. You are told only your own standing in the order, for example if you are no longer leading.
6.2A submitted bid is a legally binding offer to purchase at that figure if accepted. Bids cannot be withdrawn.
6.3Every Lot is sold as is. Read the full description, and satisfy yourself as to ownership, condition, authenticity, mileage, finance and any third-party rights. We recommend an inspection before bidding. We do not independently verify seller information.
6.4Buyer's fee. Buyers pay a separate fee of 2.5% + VAT of the hammer price, in addition to the hammer price and any charges stated in the listing.
6.5A Reserve may be set and is usually hidden. We may accept bids below the Reserve, and where the Reserve is not met we may contact bidders to negotiate a private treaty sale. The Seller decides whether to accept.
6.6If you win more than one Lot you must complete on each of them. All sums are payable in pounds sterling unless the listing states otherwise.
7. Payment, collection and completion
7.1We invoice the Buyer on the sale date. Cleared funds for the hammer price, the buyer's fee and any stated charges must be received within five business days.
7.2Where escrow is used, cleared funds must be held by us before the motor car is released for collection or delivery.
7.3Unless the listing says otherwise the Buyer arranges and pays for collection or transport. Buyer and Seller agree that we may share their contact details for that purpose, and each agrees to confirm collection to us in writing.
7.4Risk and title pass to the Buyer when the Buyer or their carrier takes physical possession, unless the sale contract states otherwise.
7.5If the Buyer does not pay or does not collect within the periods above, the Seller may, on notice, cancel the sale and resell, or enforce the sale contract, and we may charge the fees that would have been due had the sale completed. If the Seller causes the failure, the Buyer's funds are returned and the Seller remains liable for our fees.
7.6Once collection has taken place we pay the Seller the hammer price less our commission and any other sums owed.
7.7All fees are exclusive of VAT, which is payable in addition at the prevailing rate, and are non-refundable. Your statutory rights as a consumer are unaffected.
8. Returns
8.1We are not the seller and a motor car cannot be returned to us. Any right of return is against the Seller.
8.2Where the Seller sells in the course of a business and the Buyer buys as a consumer, statutory cancellation rights may apply. A returned motor car must be unused since notice was given, in the same condition, and returned with all keys, service history, manuals and documents.
9. Additional services
9.1We may offer photography and copywriting, sale preparation and valeting, storage and transport introductions. Charges are quoted at the time of booking and are normally payable then.
9.2Photographs we produce are for the listing of that motor car, may carry our markings, and may not be used elsewhere without our written agreement. Images are for identification and may not reproduce colour or condition exactly.
10. Liability
10.1We are not liable for losses not caused by our breach, for loss of profit, opportunity, revenue, data or goodwill, or for indirect or consequential loss.
10.2Where we are liable, our liability is limited to the fees in dispute and in any event to the total fees you paid us in the twelve months before the event giving rise to the claim.
10.3We are not liable for the accuracy of a Lot description, or for the condition, ownership, authenticity or quality of a Lot, or for any finance or third-party interest affecting it.
10.4Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited.
11. General
11.1How we handle your details is set out in our privacy and cookies notice.
11.2These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
11.3Questions about these terms, and any request to close an account, should be sent to admin@hunthammerauctions.com.
